# One Elsewhere – Terms of Service

Please read these Terms of Service (“Agreement”) carefully.

This Agreement is a legally binding contract between you and One Elsewhere (“we,” “us,” or “our”) and governs your use of the One Elsewhere mobile application (the “App”).

By downloading or using the App, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, please stop using the App. You confirm that you are at least 13 years old.

## 1. Changes to This Agreement

We may update this Agreement from time to time. When changes are made, the “Last Updated” date will be revised.

Your continued use of the App after changes means you accept the updated Agreement. If you do not agree with the changes, you must stop using the App.

## 2. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how information is collected and used.

The Privacy Policy is incorporated into this Agreement by reference.

## 3. Eligibility

### 3.1 Individual Use

The App is available only to individuals aged 13 or older.

If you are under the age of majority in your region, you may use the App only with the consent of a parent or legal guardian.

## 4. Accounts & Access

One Elsewhere does not require account registration to use the App.

Some features and data (such as focus sessions or statistics) may be stored locally on your device or handled through Apple system services.

You are responsible for maintaining access to your device and Apple ID.

## 5. Purchases

### 5.1 One-Time Purchase

One Elsewhere offers an optional one-time purchase that unlocks additional features.

- All purchases are processed by the Apple App Store  
- We do not collect or store payment information  
- Purchases are subject to Apple’s payment policies  
- Refunds are handled by Apple and not by us

### 5.2 Restore Purchases

If supported, you may restore your purchase using Apple’s standard “Restore Purchases” functionality.

## 6. Acceptable Use

You agree not to:

- copy, modify, distribute, or reproduce the App or its content  
- reverse-engineer, decompile, or attempt to access the source code  
- interfere with the App’s operation or security  
- use automated tools, bots, or scraping techniques  
- upload malicious code or attempt to disrupt the App  
- use the App for unlawful, abusive, or harmful purposes

Violation of these rules may result in suspension or termination of access.

## 7. App Content

### 7.1 Ownership

All design elements, visuals, sounds, interface components, text, and other materials provided within the App (“App Content”) are owned by One Elsewhere.

You may not copy, reuse, or redistribute App Content without prior written permission.

## 8. Focus & Habit Disclaimer

One Elsewhere is designed to support focus, intentional time, and personal habits.

The App does not provide:

- medical advice  
- psychological counseling  
- mental health diagnosis  
- professional or therapeutic services

The App is not a substitute for professional care.

If you require medical or mental health support, please consult a qualified professional.

## 9. Disclaimer of Warranties

The App is provided “as is” and “as available.”

We do not guarantee that:

- the App will be uninterrupted or error-free  
- data will always be preserved  
- the App will meet all personal expectations

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

## 10. Limitation of Liability

To the fullest extent permitted by law:

- We are not liable for indirect, incidental, or consequential damages  
- We are not responsible for data loss, device issues, or usage interruptions  
- Our total liability shall not exceed the amount you paid for the App (or $0 if no purchase was made)

Some jurisdictions do not allow certain limitations; in those cases, applicable legal protections apply.

## 11. Termination

You may stop using the App at any time.

We may suspend or terminate access if you:

- violate this Agreement  
- misuse the App  
- engage in fraudulent or harmful activity  
- or if the App is discontinued

Termination does not entitle you to refunds.

## 12. Intellectual Property

All trademarks, branding, designs, and App logic remain the exclusive property of One Elsewhere.

Nothing in this Agreement grants you ownership or license to our intellectual property beyond normal App usage.

## 13. Governing Law

This Agreement is governed by applicable laws of the jurisdiction in which One Elsewhere operates, without regard to conflict of law principles.
